1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and NexHunt ("Company", "we", "us", or "our") governing your access to and use of the NexHunt platform, including our website, applications, and AI-powered analysis services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Nature of Service & Important Limitations

NexHunt is an AI-powered analytical tool that provides probabilistic analysis of prediction markets for informational and educational purposes only.

2.1 What We Provide

• AI-generated probabilistic analysis of prediction markets
• Data aggregation from publicly available sources (OSINT)
• Educational content about market dynamics
• Probability estimates based on public data analysis

2.2 What We Do NOT Provide

• Investment advice, financial guidance, or personalized recommendations
• Suggestions to place wagers or make financial decisions
• Guarantees of accuracy, profit, or specific outcomes
• Trade execution or custody of funds (Non-Custodial)
• Gambling services or facilitation of bets

2.3 Regulatory Status

NexHunt is NOT registered as a financial advisor, investment advisor, commodity trading advisor (CTA), or any similar regulated entity. We do not hold ourselves out as experts qualified to provide investment advice. Our AI-generated analysis should be treated as one of many data points you might consider, not as professional guidance.

3. Eligibility Requirements

To use the Service, you must:

• Be at least 18 years of age, or the age of legal majority in your jurisdiction (whichever is higher)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Not be located in a jurisdiction where prediction markets or our Service are prohibited
• Not be on any government sanctions list or restricted party list

By creating an account, you represent and warrant that you meet all eligibility requirements.

4. Regulatory Compliance

4.1 U.S. Regulations

While NexHunt analyzes regulated event contracts (including those under CFTC jurisdiction), access to underlying markets depends on your local laws. Users are responsible for:

• Verifying the legality of prediction markets in their state/jurisdiction
• Complying with all applicable federal, state, and local laws
• Understanding that certain states (e.g., Nevada, Washington) may restrict prediction market participation

4.2 International Users

Users outside the United States must comply with their local laws regarding:

• Online gambling and prediction markets
• Financial services regulations
• Data protection requirements (including GDPR)

4.3 No Fiduciary Duty

NexHunt owes no fiduciary duty to users. Our relationship is strictly that of a publisher and subscriber. We do not act as your agent, advisor, or fiduciary in any capacity.

5. Account Registration & Security

5.1 Account Creation

When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Maintain the security of your password and credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

5.2 Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abusive behavior toward staff or other users
• Attempts to manipulate or exploit the Service

6. Subscriptions & Payments

6.1 Subscription Plans

• Free Plan: Limited monthly analyses with basic features
• Paid Plans: Various tiers with increased analysis credits and features
• Credit Packs: One-time purchases of analysis credits (non-expiring)

6.2 Billing

• Subscriptions are billed in advance on a recurring basis (monthly)
• Credits reset at the beginning of each billing cycle for subscription plans
• Prices are subject to change with 30 days notice

6.3 Refund Policy

No Refunds: Due to the nature of digital information services, we do not offer refunds once analysis has been accessed or credits have been used. You may cancel your subscription at any time, which will prevent future charges but will not refund the current billing period.

6.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

7. Intellectual Property

7.1 Our Content

All content, features, and functionality of the Service, including but not limited to:

• AI-generated analyses and reports
• Software, algorithms, and models
• Website design, graphics, and user interface
• Trademarks, logos, and brand elements

are owned by NexHunt and are protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You may not:

• Copy, modify, or distribute our content
• Reverse engineer or decompile our software
• Use automated systems to access the Service (scraping, bots)
• Resell or redistribute our analyses

8. Data Integrity & OSINT Policy

NexHunt is committed to market integrity. Our AI agents utilize Open Source Intelligence (OSINT) exclusively:

• We rely solely on publicly available data (news, polls, government reports, social media)
• We DO NOT use, seek, or sell material non-public information (MNPI)
• We DO NOT engage in or facilitate insider trading
• Any prediction matching an "insider" outcome is coincidental based on public data analysis

9. Disclaimers & Limitation of Liability

9.1 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of analyses
• Uninterrupted or error-free operation
• Security of data transmission

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXHUNT SHALL NOT BE LIABLE FOR:

• Any financial losses resulting from decisions based on our analyses
• Errors, inaccuracies, or "hallucinations" in AI-generated content
• Regulatory actions taken against you in your jurisdiction
• Technical failures, service interruptions, or data loss
• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless NexHunt and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your trading activities based on our analyses

11. Dispute Resolution & Arbitration

11.1 Informal Resolution

Before initiating formal proceedings, you agree to contact us at contact@nexhunt.ai to attempt informal resolution of any dispute.

11.2 Binding Arbitration

Any dispute not resolved informally shall be resolved by binding arbitration under the rules of the American Arbitration Association. The arbitration shall be conducted in Delaware, USA, in English.

11.3 Class Action Waiver

YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All claims must be brought in your individual capacity, not as a plaintiff or class member.

11.4 Governing Law

These Terms shall be governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website
• Sending an email to your registered address
• Displaying a notice within the Service

Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
